Division Bench of Delhi High Court in the matter of HPL (India) Limited Vs. QRQ Enterprise, FAO (OS) (COMM) No. 12/2017 was considering the effect of Section 13 of Commercial Courts, Commercial division and Commercial Appellate Division of High Courts Act, 2015 (Commercial Courts Act). It was held that the proviso to Section 13(1) of Commercial Courts Act makes it abundantly clear that an appeal shall lie from such orders passed by a Commercial Division or a Commercial Court that are ‘specifically enumerated’ under Order XLIII of the CPC, as amended by the said Act and Section 37 of the Arbitration and Conciliation Act, 1996.
